Make a claim to the head of thean organization that violated your rights. Describe what actions of its employees were not legitimate in the provision of certain services. Refer to the sections of Russian legislation that have been violated, and advise that if you ignore your claim, you will have to go to court. Sign the document and send it to the legal address of the organization. After making sure that the manager has received your application, wait 10-20 days, and if during this time the issue is not resolved in your favor, begin to write an appeal to the court.

Write the statement of claim to the authorizedjudicial instance. In case of violation of rights in the sphere of provision of services, an action should be submitted to a civil or arbitration court, depending on the nature of the dispute. When drafting an action, follow the relevant procedural code of the Russian Federation. In addition to the name of the judicial body, indicate the names of the persons participating in the case, their address data and requisites, the subject matter of the complaint and your requirements.

Pay the state duty for filing a claim in the bankingand attach a receipt to your application. Also attach to it all the documents and other data that can be used by the court when considering the case in your favor. Sign the claim and send it to the address of the court or personally to the staff of the office. Who is covered by the Consumer Protection Law

The Law of Ukraine "On Protection of Rightsconsumers "establishes clear rules of the game between buyers and sellers (producers) about the acquisition of goods, works and services. This law applies to businesses and citizens who buy something to satisfy their personal needs. In relation to legal entities acting as buyers, the law on the protection of consumers' rights is not applied.

What consumer rights are protected by law

The law protects the rights of consumerspurchase of goods, works and services. These rights concern not only the quality of goods, but also its security, the availability of complete and reliable information about it. So, the law prescribes how to act in the event that an improper quality product was sold or for some reason (color, size, etc.) did not fit the buyer. Similarly, the rights of consumers are secured in the event that they receive work or services. It defines the law and the rights of buyers in the sphere of trade and consumer services. However, here the consumer must additionally be guided by the rules of trade in certain types of goods, which are approved by the Cabinet of Ministers and other state bodies of Ukraine. So, at present, the rules of trade in food and non-food products, alcoholic beverages, tobacco products, etc. are in force. Substantial attention is paid to the law of consumers' realization of their rights in certain types of trade. For example, a separate article of the law is devoted to the rights and obligations of creditors and borrowers in the case of purchasing goods on the terms of consumer credit. Also, the law prescribes the rights of consumers in the event of the purchase of goods outside commercial premises. It is established by law and responsible for certain violations in the field of consumer protection. For example, penalties can be applied for the lack of price tags for goods, for refusing to issue a check or to exchange poor-quality goods.

Where to complain to the consumer in case of violation of his rights

In Ukraine there is a special statethe body that deals with the protection of consumers' rights. This is the State Inspectorate for the Protection of Consumer Rights and its territorial bodies. Its competence includes monitoring compliance with legislation in the field of consumer protection. Any buyer, in case of violation of his rights, can apply there with a written complaint. And then the enterprise of trade should wait for the verification and imposing of significant penalties.
