How to rewrite a share
The share of the apartment is part of the property,which is privately owned by an individual. To rewrite the share of another person, that is, to make it the owner, it is necessary to draw up an agreement on donating the share of the apartment and register it in the department of the Federal Service for State Registration, Cadastre and Cartography at the place of residence.

Gather the documents proving the rightownership of the share of the apartment. Without them, the gift contract will not be considered valid. First of all, you will need a certificate of registration of ownership of a share of real estate, which is the object of donation. It is also necessary to attach to the package of documents an extract from the house book for the apartment where the share is located, the original and a certified copy of the cadastral passport and a notarized statement of the donor's spouse that she (he) has no objection to transferring the share of the apartment to property to another person.

Fill in the contract for donating the share of the apartment,A sample of which can be downloaded from specialized websites on the Internet or obtained from the Department of the Federal Service for State Registration, Cadastre and Cartography at the place of residence. For registration of the contract, passport data of the donor and the donee will be needed. It will also be necessary to document how much the given share of real estate is valued and who pays for the transaction costs.

Make a gift contract with a notary, and then,as required by Art. 574 of the Civil Code of the Russian Federation, register the gift certificate in the Federal Registration Service or its department at your place of residence. If desired, you can arrange in the presence of a notary a symbolic transfer of gift in the form of keys from the apartment or room in which the donated share is located.

Consult with a notary if you giveThe share of real estate to a minor (in this case, control of the guardianship authorities is necessary) or the share of the apartment for which the mortgage loan is extended (the consent of the bank will be required). Please note that for the commission of the gift certificate, both parties to the transaction must be legally capable. In the event that the share of the apartment is given to a family member (close relative), the property tax does not apply to it.
