Conditions for the justifiable use of weapons by citizensThe RF is fixed in a special federal law. It should be borne in mind that in all cases of such use the weapon must be kept by a person lawfully.
Justified is the use of such weapons,which is committed by a Russian citizen in a state of extreme necessity, necessary defense. At the same time, weapons must be kept by the person using it on legal grounds, and the purpose of application should be protection of life, health, property. Before using the weapon, a clear warning must be followed by the person in respect of which it will be used. Do not make such a warning is possible only if any delay creates a danger to people's lives, can lead to other severe and irreversible consequences. If the weapon is used against a particular person by a person in a state of necessary defense, then the obligatory condition for the lawfulness is the absence of harm to any other persons.
Prohibitions related to the use of weapons
The use of weapons is not considered justified,when implemented against women, minors or those who have external signs of disability. Exceptions are only cases of mass or armed attack by these categories of citizens. Even with the right to bear arms, it is forbidden to carry them to those who take part in any mass events. The nature of the public event is not of decisive importance, since the ban applies to meetings, processions, demonstrations, sports, entertainment and other events.Other features of the use of weapons
If there is a weapon on a legal basisa citizen must take into account the existence of a ban on its exposure. This prohibition applies to all cases, except for the situations outlined above, in which the use of weapons is deemed justified. If the weapon was still used, then the person applying it is under an obligation to report this circumstance to law enforcement agencies. In this case, the message should be made to the police department located at the site of the use of the weapon, and the maximum period for the transfer of such information is the day after the use of the weapon. It should be taken into account that the extreme necessity, the necessary defense, are those circumstances which, if confirmed, exclude the crime of the act. That is why when using weapons in these circumstances, a person is not brought to criminal liability.
