What are the main functions of licensing?
Some types of entrepreneurial activitycan be carried out only on the basis of a license issued by a state body authorized to do so. There are more than 50 such types, they are listed in articles 1 and 12 of Federal Law No. 99-FZ of 04.05.2011 "On licensing of certain types of activities". The main objective of licensing is the prevention of possible damage, which can be caused as a result of commercial activities.

Article 2 of Law No. 99-FZ defines the basicthe function of licensing as prevention of damage, which can be inflicted on rights, legitimate interests, human health, as well as habitat or historical and cultural monuments, state interests, national security as a result of certain types of entrepreneurial activities. So, in particular, obtaining a license is required for passenger transportation, in the case when the number of passengers exceeds 8 people; for repair, adjustment, installation and maintenance of fire safety systems; for pharmaceutical, medical and educational activities. The production and sale of alcohol products, crediting and insurance are also licensed.

For registration of the license the enterprise whichwill engage in licensed activities, must meet certain requirements. Of course, for each of these types of activities, these requirements are different. But, in general, they are aimed at the fact that qualified specialists with special education and all necessary equipment, cars, vehicles, etc., are engaged in this or that business. In some cases, one of the conditions for obtaining a license is the availability of real estate objects and a certain the amount of the authorized capital. When issuing a license, the company's management is obliged to collect and submit a whole package of documents, which serves as a confirmation and guarantee that this activity will not cause harm to citizens or the environment.

The issuance of licenses is authorized to carry out suchfederal bodies, such as the FSB, the Ministry of Emergency Situations, the Ministry of Internal Affairs, and regional authorities. In the first case, the validity of this document extends to the entire territory of Russia, while in the second case it may be limited to the territory of only one region. Some licenses do not have a finite period of validity, and some are renewable, they need to be re-confirmed after some time.

To obtain a license, you should contactapplication to the body that licenses this type of activity. The required package of documents is submitted in notarized copies with the inventory. The time for consideration of the application is 45 days from the time of filing, and in some cases even less. After obtaining a license, you can engage in this activity the next day.
