How to hold an open auction
Open auction - this is a tender, the winner of which is a firm that offered the lowest price for a state or municipal contract. If the initial price of the contract does not exceed one million rubles, auction can be conducted in electronic form on the website on the Internet.
You will need
- - an announcement in the official publication about the conduct of the auction;
- - competitive documentation (initial price, conditions for participation in the competition, requirements for participants, etc.).

Give the order to hold auctionbut also the creation of a competitive commission. Please note, the commission must be created before the announcement of auctione. The commission should include at least 5 people. It is desirable that they have a special training and experience in bidding for placing orders for state or municipal needs.

Develop a notice, tender documentation anddetermine the initial price of the contract. In the announcement, which you plan to give, the short characteristics of the purchased goods, works and services should be indicated.

Place the publication about the open auctionbut also the tender documentation for it. This should be done in official publications and on the website http://zakupki.gov.ru. Please note, you can make changes to the bidding documents not later than twenty days before the deadline for submission of applications, but all changes must be published in the print edition. Refusal to hold an open tender is allowed 15 days before the deadline for applications.

Accepting applications for participation in auctione, keep the information contained in them confidential. Remember, before opening envelopes, the participant can withdraw or change his application.

The climax of the open auctionbut is the opening of envelopes with applications. You need to do this in one day, logging all the data into the protocol. In doing so, do not forget: the customer must maintain and keep for three years the audio recording of the procedure for opening envelopes. All participants of the competition have the right to audio and video recording of this process. Late applications are not considered, but must be opened and returned to the applicant on the same day.

Having considered all applications for auction, check them for the accuracy of the information. For this purpose, the legislation allocates 10 days. Having compared the proposals, determine the winner and publish the protocol of evaluation and comparison of applications.

After you give the winner a draft contract andone copy of the protocol. You need to do this for 3 days. If the winner of the tender refuses to sign a contract, you have the right to force him to perform the contract through the court. Or, as an option, sign a contract with the next best bidder. It is possible to adjust the price, but not more than five percent and only for works and services.

If on auction received only one application, the competition is recognizedfailed. But if this single application meets the requirements and conditions of the competition, and the proposed price does not exceed the initial price, the customer is obliged to conclude a contract with a single participant auctiona.
