The reasons for expulsion from the country are illegal stay in it and the absence of a visa. To avoid deportation, it is necessary to know the legal requirements and observe the established immigration conditions of the state in which the foreign citizen is located.

How to avoid deportation

Instructions

1

So that you are not deported, observe the highmoral principles, live according to the laws of the country in which you are present. You must stay here continuously from five to seven years. It is necessary to prove to the authorities that the expulsion will entail economic and other difficulties that will negatively affect the members of your family.

2

Submit to the authorities of the country a petition for politicalasylum. In doing so, you will need to prove that you have been subjected to unfair persecution or are afraid of alleged persecution for national, racial, religious, political or social reasons. If you failed to substantiate the application for political asylum, you can be deported to another country, and not to where you are from.

3

Do not enter the country illegally. Do not attempt to obtain a visa, the right to work in the country or other documents fraudulently through illegal fraud (forgery). Do not enter into a fictitious marriage with a resident of the country in which you reside. If the visa term expires, the authorities of the country will call into question such a marriage union and you will necessarily be deported. If you were detained for committing crimes or for an article related to the possession of narcotic substances, wait deportation from the country.

4

Leave the country voluntarily. This last chance before the hearing with the participation of an immigration judge allows you to leave the country with minimal consequences. In this case, you can return to the country on a visa, while deportation prohibits entry into the territory of that country for several years. Please note that in the event of a voluntary departure, you will have to pay for transportation costs yourself.

5

If you received a notification about deportation, the best way is to hire an immigration lawyer who will give qualified advice on how to avoid expulsion from the country.

Tip 2: Threatened by a kiss with Buddha

Recently news agencies distributedreports of an incident that happened to French tourists on the island of Sri Lanka. This fabulously beautiful place, which many travelers call paradise on Earth, attracts a lot of tourists from different countries. Amazing, lush tropical nature, warm climate, many interesting sights. But, as it turned out, even in such a fantastic place hiding their dirty tricks.

What threatens a kiss with Buddha

Three French tourists - two women and a man -Enjoy the beautiful views of the island, taking pictures against their background. It would seem that the most common and natural behavior! And since the dominant religion in Sri Lanka is Buddhism, then the Buddha statues are literally everywhere at every step. After visiting the city of Kandy in the central part of the island, the French saw a beautiful statue of a deity and decided to take a picture next to her. At first the man sat down near the statue, repeating the pose of the stone god, and then one of the women kissed the Buddha on the lips. From the point of view of Europeans, nothing reprehensible and criminal tourists did. In the worst case, their actions could be regarded as frivolous, nothing more. However, the inhabitants of Sri Lanka had a different opinion on this matter. The owner of the photo studio, located in another city of Halle, where tourists wanted to print their pictures, saw this as an insult to the deity and immediately complained to the police. The fact is that such actions in relation to the image of the Buddha, according to local laws are regarded as sacrilege! And this is a criminal offense. Puzzled tourists were detained by the police. Of course, the French did not want to offend the religious feelings of local residents. Most likely, they just did not hear about such a law. But, as they say, ignorance of the law does not absolve from responsibility for its violation. The French easily escaped, although sacrilege is considered a serious crime in Sri Lanka, the court reacted to them very leniently, sentencing them to six months in prison. In addition, unlucky tourists must pay a small, purely symbolic penalty. The French escaped deportation from Sri Lanka, they were allowed to continue their journey around the island. However, in the case of another offense on their part, the conditional term becomes real. Of course, this story may seem absurd. Well, how much damage did the statue of the Buddha from kissing on the lips? Nevertheless, for a long time there is a saying: "They do not go to a foreign monastery with their charter." To avoid getting into such a ridiculous and unpleasant situation, before going to a foreign country, you need to bring information about it, learn its laws, customs and traditions, what actions there are considered unacceptable.

Tip 3: What is emigration?

In a broad sense, emigration (from Latin. emigro - evicted) - the movement of any organism from its usual habitat to another place. Most encyclopedic and explanatory dictionaries define it as the resettlement of citizens from one country to another for various reasons.

What is emigration?

In his dictionary of the Russian language, D.N. Ushakov gives another definition of emigration - permanent or long stay outside his country as a result of resettlement. Departure from the country of citizens in case of emigration is voluntary, sometimes forced, as opposed to deportation - forced eviction. Immigration differs from tourist trips or trips with different purposes abroad by what means a change of permanent residence. However, a change of citizenship is not necessary in this case. Some countries allow you to have, besides your own, several more citizenships. By this sign, emigration is divided into temporary and permanent (irrevocable or final). Voluntary resettlement can occur for the following reasons: economic (departure to work), personal (for example, family reunification), on political or religious beliefs. From the country, a citizen can leave for permanent residence (permanent residence) in the historical homeland (ethnic emigration). The forced relocation can occur because of world financial crises, hunger, poverty, political persecution, religious wars, ethnic conflicts, for environmental and special personal reasons. Frequent reasons for forced emigration are the inability to find a good job, to get a decent education, difficulties in implementing professional, creative and family plans in your country. Along with the exit permitted by the country legally, there is a so-called "black" emigration - illegal crossing of the border. Usually it is resorted to by citizens who do not have the opportunity to go to another country legally. Most often, illegal resettlement is associated with the search for any means of livelihood. One of the most popular types of legal departure is now labor emigration on a working visa. Three waves of migration are typical for Russia: the White emigrant (first half of the 20th century), the Jewish-Odessa (70-80s of the 20th century) and the mixed economic (90s of the 20th century, continue to the present).

The use of deportation is not a consequence of the commission of any offense, therefore it can not be regarded as a form of administrative punishment. At the same time, administrative deportation is appointed specifically for committing offenses, entails negative legal consequences and additional restrictions for violators. The categories of "administrative expulsion" and "deportation" are unreasonably identified by some lawyers, but expulsion is an administrative punishment.

Administrative deportation can be appointedonly in relation to foreign citizens, stateless persons. The exclusive right to apply this type of punishment is assigned to the court, but the cases of committing offenses by foreign nationals at the border are exceptional, since in this case this measure can be applied by other bodies, officials. Before the expulsion, the guilty person may be held in a special institution for a certain amount of time. The procedure itself can be implemented in two main forms: forced departure and controlled independent departure. The court chooses a specific form of deportation in each case, however in practice an independent controlled exit is applied to violators according to the results of the first administrative offense.

For what offenses is an expulsion appointed?

Administrative expulsion isan additional measure of administrative punishment, which is assigned together with a fine. In some cases, the application of this measure of responsibility is left to the discretion of the authorized body, which considers a particular case (depending on the sanction formulation of the administrative rule). The most part of offenses, at the commission of which expulsion can be applied, is connected with violation of the rules of entry into the Russian Federation, rules of staying on its territory. These compounds are fixed in Chapter 18 of the Code of the Russian Federation on Administrative Offenses.
