How to apply for a lease of a land plot



In modern conditions of land managementoften become the object of lease. In order to exclude possible misunderstandings when using land, it is necessary to observe a number of mandatory requirements when drawing up a lease agreement, having concluded a corresponding agreement. The basic rules of land registration are set out in the Land Code of the Russian Federation.

Read the provisions of the Land CodeThe Russian Federation regulating the lease of land plots. Particular attention is paid to Article 27 of the Code, which describes the restrictions imposed on the turnover of land. In paragraph 4 of Art. 27 contains a complete list of lands withdrawn from circulation and located exclusively in federal ownership.

Determine, guided by the Land Code of,Does not the site that you want to rent fall into the category of land withdrawn from circulation. You can not conclude a lease, in particular, if the land is managed by a national park or a nature reserve, it is located within the boundaries of the land allocated for municipal needs.

Make a lease of the site. Use as a basis the standard form given in chapter 34 of the Civil Code of the Russian Federation, and the recommendations set forth in the Land Code. Provide in the contract the amount of rent for the land; in the event that the object of the contract is municipal or state land, the question of rent is within the competence of the Government of the Russian Federation.

Finalize the contract by agreeing itdetails with the landlord. The land lease agreement must be executed in writing, while the notarial certificate of it is not obligatory. If you find it difficult to make a contract yourself, ask for qualified help from a legal agency.

Make sure that as a landlord in the contractthose persons who have the right to conclude it are indicated: owners or persons authorized by law (if the subject of the contract is municipal or state land). If this condition is not fulfilled, the contract may be declared invalid, and you will incur unreasonable financial losses.

Submit to the registration authority a statement ofregistration of the lease agreement, attaching to it a cadastral passport of the site, a plan for surveying the leased land, an expert's conclusion indicating the estimated value, calculation of lease payments, a receipt for payment of the state fee. The deal will become legally effective only after passing the state registration.
